1.1 Categories We DO NOT Collect

We do not collect the following types of personal information:

  • Sensitive Personal Information (as defined by CPRA): Social Security number, driver's license, passport, financial account credentials, precise geolocation, racial/ethnic origin, religious beliefs, union membership, genetic data, biometric data for unique identification, health information, or information about sex life or sexual orientation
  • Protected Classifications: Age, race, disability status, citizenship, marital status, military/veteran status
  • Education Information: Student records or educational history
  • Professional/Employment Information: Job title, employer, work history

1.2 Third Parties That Receive Your Information

We share your personal information with the following categories of third parties:

Note: All third-party service providers are bound by contractual obligations to protect your data and only use it for the specified purposes.

1.3 Sale or Sharing of Personal Information

We do NOT sell your personal information to third parties for money.

Under CPRA's broad definition of "sharing," we may "share" the following categories with analytics providers (Google Analytics) for cross-context behavioral advertising purposes:

  • Internet/Network Activity (usage patterns, pages visited)
  • Identifiers (IP address, device identifiers)
  • Geolocation Data (approximate location from IP)

We do not sell or share personal information. We use Google Analytics solely for internal website analytics with advertising features disabled. We honor Global Privacy Control (GPC) signals automatically.

1.4 Guest User Data Collection

This Privacy Policy applies to both registered users (those with accounts) and guest users (those who access the service without creating an account).

Data Collected from Guest Users:

  • Session Data: Word counts, writing duration, timestamps, and session mode (Write It Down or Think Out Loud)
  • Technical Data: IP address, browser type, device information, operating system
  • Analytics Data: Page visits, feature usage, and interactions (collected via Google Analytics)

Retention Period: Guest user data is retained for 13 months, consistent with Google Analytics retention settings. Session data is stored temporarily in browser local storage and is not transmitted to our servers unless you create an account.

Your Rights: Guest users have the same CCPA/CPRA rights as registered users, including rights to know, delete, correct, and opt-out. To exercise these rights, guest users can submit a verifiable consumer request via our contact form or email. We will verify your identity through email confirmation and IP address matching before processing requests.

2. How We Use Your Information

We use your information to:

  • Provide and maintain the writing service
  • Save your writing sessions and track your progress
  • Send you authentication emails (account verification, password resets)
  • Improve our service and develop new features
  • Understand usage patterns through analytics
  • Comply with legal obligations

3. Your Writing Belongs to You

You own 100% of the content you create on Unstoppable Ink. We claim no intellectual property rights over your writing. Your words are yours, always.

4. How We Store and Protect Your Data

Your data is stored securely using Supabase, a trusted cloud infrastructure provider. We implement:

  • Encrypted database connections
  • Secure password hashing (your password is never stored in plain text)
  • Industry-standard security practices
  • Regular security updates

5. Cookies and Tracking

We use cookies for:

  • Authentication: To keep you logged in
  • Analytics: Google Analytics uses cookies to track usage (you can disable this in your browser)

You can control cookie settings through your browser preferences.

6. Third-Party Services

We use the following third-party services:

  • Supabase: Database and authentication hosting
  • Google Analytics: Usage tracking and analytics
  • Google OAuth: Sign-in with Google (optional)
  • Sentry: Error monitoring to improve service reliability

These services have their own privacy policies governing their use of your information.

7. Your Rights and How to Exercise Them

7.1 Your Privacy Rights

You have the right to:

  • Access (Right to Know): Request a copy of the personal information we have collected about you
  • Correction: Request that we update or correct inaccurate information
  • Deletion: Request deletion of your account and all associated personal data
  • Export (Data Portability): Download your writing content in a portable format at any time
  • Opt-Out of Sale/Sharing: We do not sell or share your personal information, so opt-out is not applicable
  • Limit Use of Sensitive Personal Information: We do not collect sensitive personal information as defined by CPRA

7.2 How to Submit a Request

To exercise any of these rights, you may submit a request through two designated methods:

  1. Web Form: Submit a request through our Contact Form
    Select "CCPA Data Request" as your subject and describe your request
  2. Email: Send your request to support@unstoppable.ink
    Include "CCPA Request" in the subject line

7.3 Identity Verification

To protect your privacy, we must verify your identity before fulfilling requests. Our verification process depends on whether you have an account:

  • If you have an account: We will verify your identity by confirming your email address through a verification link sent to the email associated with your account.
  • If you do not have an account: We will verify your identity by:
    • Matching the email address you provide with our records
    • If we cannot match your information, we may request additional information such as approximate dates of service use or specific content you created
  • For deletion requests: We use a higher standard of verification and may require additional confirmation to ensure the request is legitimate.

7.4 Authorized Agents

You may designate an authorized agent to submit requests on your behalf. To verify an authorized agent, we require:

  • Signed written permission from you authorizing the agent to act on your behalf, OR
  • A valid power of attorney under California Probate Code sections 4000-4465

We may also require the authorized agent to verify their own identity and may require you to directly verify your identity with us.

7.5 Response Timeline

We will respond to your verified consumer request within 45 days of receipt. If we need more time (up to 90 days total), we will notify you of the extension and the reason.

We will deliver our written response electronically unless you request otherwise.

7.6 No Discrimination

We will not discriminate against you for exercising any of your privacy rights. Specifically, we will not:

  • Deny you goods or services
  • Charge different prices or rates
  • Provide a different level or quality of service
  • Suggest you will receive different prices, rates, or quality of service

7.7 Account Holders

If you have an account, you can also manage your data directly through your Account Settings:

  • Export your data: Download all your writing content
  • Delete your account: Permanently delete your account and all associated data
  • Update information: Change your name, email, or password

8. Data Retention and Deletion

8.1 How Long We Keep Your Data

We retain your personal information only as long as reasonably necessary to provide our services, comply with legal obligations, resolve disputes, and enforce our agreements. Below are the specific retention periods for each category of data we collect:

8.2 Anonymized Data

After the retention periods above, some data may be retained in anonymized form (with all personally identifiable information removed) for research and service improvement purposes. Anonymized data cannot be linked back to you and is not considered "personal information" under privacy laws.

8.3 Account Deletion

If you request account deletion, we will:

  • Immediately: Deactivate your account and stop data collection
  • Within 24 hours: Delete your writing content from active databases
  • Within 30 days: Purge your account data from all systems and backups
  • Within 90 days: Complete final removal including archived logs
  • Exceptions: We may retain anonymized analytics data and legally required records (payment transactions, CCPA requests) per the retention periods above

8.4 Criteria for Retention Periods

Our retention periods are determined based on:

  • Service Necessity: How long the data is needed to provide Unstoppable Ink
  • Legal Requirements: Tax, accounting, and consumer protection laws
  • Industry Standards: Standard practices for similar services
  • User Expectations: Reasonable time for account recovery and issue resolution
  • Data Minimization: Shortest period consistent with the above factors

9. Children's Privacy

Unstoppable Ink is intended for users age 13 and older. We do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided us with personal information, please contact us immediately.

10. International Users

Your information may be transferred to and processed in the United States. By using Unstoppable Ink, you consent to the transfer of your information to the United States.

11. Changes to This Policy

We may update this privacy policy from time to time. We will notify you of significant changes by email or through a notice on our website. Continued use of the service after changes constitutes acceptance of the updated policy.

Agreement to Terms

By accessing or using Unstoppable Ink, whether as a registered user or guest user, you agree to be bound by these Terms of Service and our Privacy Policy.

  • Registered users affirmatively accept these terms during account creation by checking the agreement box.
  • Guest users (users who access the service without creating an account) accept these terms through their continued use of the service.

Using any feature of Unstoppable Ink constitutes your acceptance of these Terms of Service. If you do not agree to these terms, you must immediately discontinue use of the service.

1. Description of Service

Unstoppable Ink is a web-based writing tool designed to help you overcome writer's block and build consistent writing habits. The service includes timed writing sessions, voice-to-text transcription, progress tracking, and writing statistics.

2. Eligibility

You must be at least 13 years of age to use Unstoppable Ink. By using this service, you represent and warrant that you meet this age requirement.

Our service is not directed to children under 13, and we do not knowingly collect information from children under 13. If we discover a user is under 13, we will immediately terminate their account and delete their data. If you believe a child under 13 has provided us with personal information, please contact us immediately.

3. Paid Subscriptions and Automatic Renewal

3.1 Subscription Terms

Certain features of Unstoppable Ink are available through paid subscriptions. BY PURCHASING A SUBSCRIPTION, YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT:

  • (a) Your subscription will automatically renew at the end of each subscription period (monthly or annually, depending on your selection) and continue until you cancel;
  • (b) We will automatically charge your payment method for each renewal period at the then-current subscription rate unless you cancel before the renewal date;
  • (c) You have read and understand the cancellation policy described below.

3.2 Pricing and Billing Frequency

Subscription pricing will be displayed on our website and during checkout. Your subscription will automatically renew for successive periods of the same duration at the then-current subscription rate. Subscription fees are charged at the beginning of each billing period.

3.3 Free Trials

If you sign up for a free trial, your trial period will last for the duration specified at signup. YOUR FREE TRIAL WILL AUTOMATICALLY CONVERT TO A PAID SUBSCRIPTION unless you cancel before the trial period ends.

We will send you a reminder email between 3-21 days before your free trial expires, notifying you that your trial will convert to a paid subscription and informing you how to cancel if you do not wish to continue.

Upon conversion, you will be charged the amount specified during signup and your paid subscription will begin immediately.

3.4 Price Changes

We reserve the right to change our subscription fees. If we increase the price of your subscription, we will notify you at least 7 days before the new price takes effect. You will have the opportunity to cancel your subscription before the price increase applies. Your continued use of the service after the price change takes effect constitutes your acceptance of the new price.

3.5 How to Cancel Your Subscription

You may cancel your subscription at any time through one of the following methods:

  • (a) Online: Click the "Cancel Subscription" button in your Account Settings; OR
  • (b) Email: Send a cancellation request to the email address provided on our contact page; OR
  • (c) Contact Form: Submit a cancellation request through our contact form

YOUR CANCELLATION WILL TAKE EFFECT IMMEDIATELY. You will not be charged for any future subscription periods after you cancel. If you cancel during an active subscription period, you will retain access to paid features through the end of your current billing period, but no refund will be provided for the unused portion of that period.

Cancellation is easy and requires no more steps than signing up. We will not obstruct, delay, or make cancellation unreasonably difficult.

3.6 Renewal Reminders and Notifications

We will send you email notifications to help you manage your subscription:

  • (a) Confirmation Email: Immediately after purchase, confirming your subscription terms and cancellation policy;
  • (b) Annual Reminder: Once per year while your subscription is active, reminding you of your subscription details and how to cancel;
  • (c) Free Trial Reminder (if applicable): 3-21 days before your free trial converts to a paid subscription;
  • (d) Annual Renewal Reminder (if you have an annual subscription): 15-45 days before your annual subscription renews;
  • (e) Price Change Notice: 7-30 days before any price increase takes effect;
  • (f) Material Terms Changes: Notice before any material changes to your subscription terms.

These reminders will be sent to the email address associated with your account. You are responsible for keeping your email address current.

3.7 Refund Policy

Subscription fees are generally non-refundable except as required by law. If you have questions about refunds, please contact us.

3.8 Contact Information for Subscription Questions

For questions about your subscription, billing, or cancellation, please contact us through our contact form.

4. Your Content and Ownership

You own 100% of the content you create on Unstoppable Ink. We claim no intellectual property rights over your writing. Your words are yours, always.

By using the service, you grant us only the technical permissions necessary to:

  • Store your writing content in our database
  • Display your content back to you when you use the service
  • Process your content to generate statistics (word count, completion rates, etc.)

These technical permissions exist solely to provide the service to you. We will never use your content for any other purpose, and we will never share, sell, or publicly display your writing without your explicit permission.

5. Prohibited Content and Conduct

While you have complete creative freedom, you may not use Unstoppable Ink to create, store, or share content that:

  • Is illegal or promotes illegal activities
  • Constitutes harassment, threats, or abuse toward any person or group
  • Contains hate speech, discrimination, or incitement to violence
  • Infringes on others' intellectual property rights
  • Contains malware, viruses, or harmful code
  • Violates any applicable laws or regulations

Additionally, you agree not to:

  • Abuse, harass, or threaten the service operator or other users
  • Attempt to gain unauthorized access to the service or others' accounts
  • Use the service in a manner that creates excessive operational burden
  • Interfere with or disrupt the service or servers
  • Use automated scripts or bots to access the service

6. Account Termination

We reserve the right to suspend or terminate your account at our discretion if you:

  • Violate these Terms of Service
  • Violate our Privacy Policy or other policies
  • Engage in abusive, threatening, or harassing behavior
  • Create illegal content or promote illegal activities
  • Engage in activities that create excessive operational burden on our systems
  • Engage in behavior that harms the service, other users, or the operator
  • Violate any applicable laws or regulations

You may also terminate your account at any time through your account settings or by contacting us.

7. Privacy

Your use of Unstoppable Ink is also governed by our Privacy Policy. Please review it to understand how we collect, use, and protect your information.

7.1 California Privacy Rights

California residents have specific rights under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA):

8. Email Communications

8.1 Marketing Emails

If you opted in during signup, we may send you marketing emails including:

  • Newsletter updates about new features
  • Writing tips and productivity advice
  • Special offers or promotions

You can unsubscribe anytime by:

  • Clicking "Unsubscribe" in any marketing email
  • Updating email preferences in Account Settings
  • Contacting us via the contact form

We will process unsubscribe requests within 10 business days.

8.2 Transactional Emails

Regardless of your marketing preferences, we will send important account-related emails including:

  • Subscription renewal reminders (annual notice before auto-renewal)
  • Payment confirmations and receipts
  • Account security notifications
  • Service changes that materially affect your usage
  • Trial period ending notifications

You cannot opt-out of transactional emails, as they are necessary for account operation.

8.3 CAN-SPAM Compliance

All commercial emails include:

  • Our physical mailing address (see Section 20)
  • Clear identification as promotional (if applicable)
  • A functioning unsubscribe link
  • Our business name

In Plain English: We'll only send marketing emails if you said yes during signup, and you can always unsubscribe. We'll still send important emails about your account (like "your subscription is renewing tomorrow") because you need to know that stuff.

9. Service Availability

Unstoppable Ink is provided on an "as-is" and "as-available" basis. We make no guarantees about:

  • Service uptime or availability
  • Freedom from errors or bugs
  • Compatibility with all devices or browsers
  • Meeting your specific requirements

We reserve the right to modify, suspend, or discontinue any part of the service at any time, with or without notice.

10. Data Backup

While we implement reasonable backup procedures, you are responsible for maintaining your own backups of important writing. We recommend regularly copying your content to a safe location. We are not liable for any loss of data.

11. Limitation of Liability

EXCEPT FOR LIABILITY ARISING FROM FRAUD, GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR VIOLATIONS OF LAW (WHICH CANNOT BE LIMITED), to the maximum extent permitted by law:

(a) Unstoppable Ink and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses;

(b) Unstoppable Ink and its operators shall not be liable for any damages arising from:

  • Your use or inability to use the service
  • Any unauthorized access to or alteration of your content
  • Any bugs, viruses, errors, or omissions in the service
  • Any conduct or content of third parties on the service

(c) Our total aggregate liability for any claims arising from your use of the service shall not exceed the greater of: (i) the amount you paid us in the past 12 months, or (ii) $100.

THESE LIMITATIONS DO NOT APPLY to liability for death or personal injury caused by our negligence, fraud, fraudulent misrepresentation, gross negligence, willful misconduct, violations of California consumer protection laws, or any other liability that cannot be excluded or limited under applicable law (including California law).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless Unstoppable Ink and its operators from any claims, damages, losses, liabilities, and expenses (including reasonable attorney fees) arising from:

  • (a) Your use of the service;
  • (b) Your violation of these Terms;
  • (c) Your violation of any rights of others;
  • (d) Content you create, store, or share using the service;
  • (e) Your violation of any applicable laws or regulations.

This indemnification obligation does not apply to the extent that any claim or liability arises from our gross negligence, willful misconduct, fraud, or violation of law.

13. Intellectual Property

The Unstoppable Ink service, including its design, code, features, and branding, is protected by copyright and other intellectual property laws. The service is licensed under the Apache License 2.0.

You may not copy, modify, distribute, sell, or create derivative works from the service without explicit permission, except as allowed by the Apache License 2.0.

14. Third-Party Services

Unstoppable Ink integrates with third-party technologies to provide and improve our service.

Authentication & Data Storage:

In Plain English: We use some external services to make the site work (Google sign-in, Supabase for data storage) and to understand how people use the site (Google Analytics). These companies have their own privacy rules. You can opt-out of tracking if you want.

  • Analytics data: Retained by Google Analytics per their policies (typically 26 months)
  • Performance monitoring: Sentry retains error logs for 90 days

In Plain English: We use cookies to remember you're logged in and to understand how people use the site. You can turn off tracking cookies if you want, but you'll need to keep login cookies enabled or you'll have to sign in every time.

16. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or through a notice on the service. Your continued use of Unstoppable Ink after such notification constitutes acceptance of the updated Terms.

17. Governing Law and Disputes

Note on Business Location: We operate from California, where our business activities are conducted. Our physical mailing address for correspondence is located in Michigan (see Section 20). We have chosen California law to govern these Terms because we conduct business operations in California and California consumer protection laws provide strong protections for all users.

Nothing in this choice of law limits the rights of users in other states under their applicable consumer protection laws.

18. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Unstoppable Ink regarding the service.
